Immediate Action Required

The new rules are likely to prove a complex issue for organizations that don't have:

(a) an updated and accurate inventory and understanding of their data sources (i.e., a record management program), and

(b) procedures requiring immediate, consistent and documented discovery preservation and collection action steps (i.e., a document discovery management plan).

Unless an organization is proactive and has these programs in place before a lawsuit is filed, it will be very difficult, if not impossible for organizations to convince courts to adopt limited and cost-effective discovery plans.


Process Flow
